1. Agreement to these terms
These Terms of Service govern your use of KmerHosting websites, hosting plans, domain services, client area, billing interfaces, support channels, and AI-assisted tools. By creating an account, placing an order, or continuing to use our services, you agree to be bound by these terms and by the policies referenced throughout them.
If you do not agree with any part of these terms, you should not use the service. If you are using the service on behalf of a company or organization, you confirm that you are authorized to accept these terms for that entity.
2. Eligibility and account responsibility
You must provide accurate registration information and keep it reasonably up to date.
- You must be legally able to enter into a binding agreement.
- You must maintain a valid email address for billing and service notices.
- You must keep passwords and account recovery methods secure.
- You must not resell, transfer, or share access in a way that violates plan limits or written agreements.
3. Services covered
- Shared hosting and reseller hosting
- VPS, VDS, and dedicated server plans
- Domain registration, renewals, and DNS management
- Email hosting and website application hosting
- Student and promotional offers with additional eligibility conditions
- AI tools, documentation, and support resources
4. Acceptable use
You may only use the platform for lawful, authorized, and technically responsible activities. The following is prohibited.
- Hosting, transmitting, or distributing illegal, fraudulent, defamatory, or abusive content
- Malware, phishing kits, credential theft, botnets, or software intended to compromise systems
- Spam, deceptive bulk messaging, or mail activity that harms sender reputation or delivery infrastructure
- Attempts to gain unauthorized access to systems, data, or accounts
- DDoS attacks, destructive scanning, or deliberate service disruption
- Use of shared services in a way that materially degrades the experience of other customers
5. Orders, billing, and renewals
- Invoices must be paid by the due date shown on the billing document.
- Late or failed payments may lead to suspension, restricted access, or service termination.
- Renewals for domains and hosting depend on timely payment and successful processing by external providers.
- Promotional pricing may apply only to the first term unless the offer explicitly states otherwise.
6. Suspension and termination
We may suspend or terminate a service when there is non-payment, repeated abuse, a material breach of these terms, or a credible risk to our systems or other users. You may cancel eligible services from your client area or by contacting support.
7. Resource usage and service boundaries
Shared and reseller environments rely on fair use. Excessive CPU, memory, storage, database, or network consumption may trigger throttling, process limits, temporary suspension, or a recommendation to move to a plan with dedicated resources.
8. Data, backups, and customer responsibility
- You are responsible for the content stored in your account.
- You should maintain independent backups for business-critical assets.
- You should verify your configurations, scripts, and deployment actions before execution.
9. Intellectual property
KmerHosting retains all rights in its trademarks, website materials, documentation, software components, designs, and service branding. You retain rights in the data and content you upload, but you grant us the limited rights necessary to host, process, and support that content.
10. Warranties and liability limits
- We are not liable for indirect, incidental, or consequential losses such as lost profits, lost business, or reputational harm.
- We are not responsible for losses caused by your own configuration errors, third-party software, or events outside our reasonable control.
- Our aggregate liability for direct damages is limited to the amount paid for the affected service during the three months before the claim.
11. Changes to the service or terms
We may update features, pricing, service scope, documentation, or these terms when the business, technical environment, or legal framework changes. Material updates will be reflected on this page.
12. Governing law and disputes
These terms are governed by the laws applicable in the Republic of Cameroon. The parties should first try to resolve disputes through direct good-faith discussion before escalating to formal proceedings.
